ORDER

The present Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondent herein to settle the difference in leave salary and gratuity with 6 percent interest to the 27 members of the petitioners' Association herein as per the list enclosed herewith the by considering their individual representation dated 19.3.2026.

2. The case of the petitioner Association is that 27 members of the petitioner Association retired from the respondent Corporation. Wage settlements were entered into under Section 12(3) of the Industrial Disputes Act, 1947, once in every three years, for the purpose of revising the wages of the employees of the Transport Corporation and addressing their other servicerelated demands. Such settlements were entered into on 29.06.2017, 04.10.2018, 24.08.2022 and with the implementation of the same from 01.09.2016, 01.09.2019 and 01.09.2023, respectively. However, according to the petitioner Association, the benefits arising out of the aforesaid settlements have not been extended and their terminal benefits were calculated and disbursed on the basis of the pre-revised scales instead of the revised wages payable under the settlements entered into under Section 12(3) of the Industrial Disputes Act, 1947. Hence, the petitioners have submitted representations dated 19.03.2026, respectively, seeking the revision of wages, but the same was not considered till

date. Hence, the petitioner Association is before this Court, to espouse the said cause.

3. Heard the learned counsel on either side and perused the materials available on records.

4. The stand of the petitioner cannot be disputed. In view of the Settlement arrived at under Section 12(3) of the Industrial Disputes Act, 1947, which entitles the employees of the Transport Corporation to revision of pay including gratuity and encashment of leave, the respondents are directed to pay the eligible differential amount in leave salary and gratuity as per the said settlement along with admissible interest at the rate of 6% per annum. The amounts shall be paid to the petitioners, within a period of eight (8) weeks from the date of receipt of a copy of this order.

5. With the above directions, the Writ Petition is disposed of. There shall be no order as to costs.
