PRAYER:

Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the respondents to consider the petitioner's representations dated 19.10.2017 and 07.11.2017 and to furnish guideline value and other relevant particulars in respect of the petitioner's property being Plot No.3, Ram Nagar Extension, Pallikaranai Village, comprised in Survey No.31, measuring an extent of 2 Grounds and 960 sq.ft or thereabouts by giving written explanation by the 2nd respondent in respect of objection if any to sell the property, within the time.

Mr.A.Kumar, learned Special Government Pleader takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

2. Heard both sides.

The petitioner through his representations dated 19.10.2017 and 07.11.2017, seeking for furnishing certain details as to whether the property referred to in the said representations, is an alienable property or is there any bar for selling the same, by claiming himself as the owner of the property, based on a sale deed registered as Document No.3589 of 2000. The grievance of the petitioner is that the said request has not been considered by the second respondent so far.

Therefore, this Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner, as it is for the second respondent to consider and decide the same on merits and in accordance with law. Accordingly, the writ petition is disposed of, only by directing the second respondent to consider the representations of the petitioner dated 19.10.2017 and 07.11.2017 and pass orders on the same on merits and in accordance with law, after hearing the rival claimants, if any. Such exercise shall be done by the second respondent within a period of eight weeks from the date of receipt of a copy of this order. No costs.
