Prayer: Criminal Original Petition filed under Section 438 Cr.P.C. to enlarge the petitioner on bail in the event of his arrest concerned in Crime No.1759 of 2020 on the file of the respondent police.

ORDER
(The case has been heard through video conference) The petitioner who apprehends arrest at the hands of the respondent police for the offences publishable under Sections 8(c), 20(b)(ii)(B) of the NDPS Act 1985 as amended by Act 9 of 2001 in Crime No.1759 of 2020 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner along with other accused was found in possession of 1.500 Kgs of Ganja, whithout any valid license or permit. Hence, the complaint.
3. The learned Counsel for the petitioners submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and a false case has been foisted against him. Hence, he prays for grant of anticipatory bail to the petitioner.

4.The learned Additional Public Prosecutor submitted that petitioner along with other accused was found in possession of 1.500 Kgs of Ganja, without any valid license or permit. He would further submit that one similar previous case is pending against the petitioner and hence he vehemently opposed to grant anticipatory bail to the petitioner.
5. Taking into consideration the allegations and also the bad antecedent of the petitioner and that the custodial interrogation of the petitioner is essential, this Court is not inclined to grant anticipatory bail to the petitioner.
