Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus by directing the first respondent to promote the petitioner on par with his juniors to the post of Sub-Registrar Grade-II for the panel year 1995-96 and Sub Registrar Grade-I for the panel year 2003-04 as per the G.O. (3D) No.2 dated 12.03.2007 without reference to the charge memo issued subsequently on 15.02.2008. For Petitioner :

ORDER
The limited prayer sought for in the present Writ Petition is for a direction to the first respondent to consider the petitioner's candidature for promotion on par with his junior to the post of Sub-Registrar Grade-II for the panel year 1995-1996 and Sub Registrar Grade-I for the panel year 2003-2004 without reference to the charge memo issued on 15.02.2008.
2. The decision as to whether the petitioner's name could be included in the Promotion panel or not depends on various factual https://hcservices.ecourts.gov.in/hcservices/
aspects and this court may not be able to go into the factual aspects for considering the petitioner's request and fixing up his seniority. Nevertheless, if the petitioner is granted liberty to approach the respondent seeking for redressing his grievance with a consequential direction to the respondent to consider such a request, the ends of justice may be secured. The petitioner seem to have given representation dated 28.07.2015 in this regard. However, taking into account that the representation was given six years back, the petitioner herein is granted liberty to make a fresh representation to the concerned authority namely to the second respondent herein. On such representation, the second respondent herein shall consider as expeditiously as possible within a period of three (3) months from the date of receipt of a copy of this Order. The Writ petition is disposed of on the above terms.
