Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents to retain the petitioner in service in the 3rd respondent tea factory till he completes of 60 years of age on 30.06.2024 by taking into consideration of G.O.(Ms).No.51 dated 07.05.2020 & G.O.(Ms).No.28 dated 25.02.2021 of the Personnel and Administrative Reforms (S) Department.

O R D E R

This Writ petition has been filed for a direction to the respondents to retain the petitioner in service in the 3rd respondent tea factory till he completes of 60 years of age on 30.06.2024 by taking into consideration of G.O.(Ms).No.51 dated 07.05.2020 & G.O.(Ms).No.28 dated 25.02.2021 of the Personnel and Administrative Reforms (S) Department.

2. When the matter is taken up for hearing, the learned Special Government Pleader for the 3rd respondent submitted that the petitioner was relieved from service on 30.06.2022 on attaining the age of superannuation.

3. Since the petitioner had already been relieved from service on 30.06.2022, nothing survives for adjudication in this petition. Therefore, the prayer sought for in the present Writ Petition has become infructuous.

Accordingly, the Writ Petition is dismissed as infructuous. No costs.
