...Respondents

Writ petition filed under Article 226 of Constitution of India praying this Court to issue a writ of mandamus directing the first respondent to give adequate protection to the petitioner or issue other writ or direction deem and fit proper in the circumstances of the case.

For Petitioner :

No appearance For Respondents/State :

Mr.C.Emalias, Additional Public Prosecutor For R-2 in WP.4811/2008 :

Mr.S.Manoharan COMMON ORDER When these cases were taken up for hearing, there was no representation for the petitioner. It appears that Mr.Ashok Viswanath, learned counsel on record for the petitioner is now serving as a Judicial Officer in the State Judiciary. In ordinary circumstances, this court would have posted the case to another date. But on reading the prayer in these petitions, it is seen that there was labour unrest in the factory of the petitioner in the year 2008, on account of which the petitioner apprehended breach of peace and prayed for police protection. The tense situation that obtained in 2008 may not prevail now. Therefore, no useful purpose will be served in keeping these petitions pending. Consequently, both the petitions are dismissed with liberty to the petitioner to move this Court, if they apprehend breach of peace. Connected miscellaneous petitions are also dismissed.
