ORDER
This petition is filed to direct the respondent to provide accident related documents, specifically, i)Viscera and chemical analysis report ii)Spot Pamchanama, iii)Inquest Report and iv)Detailed Postmortem Report, in Crime No.238/T3/2025.
2.Based on the petitioner's complainant, a case was registered in Cr.No. 238/T3/2025 for offences under Sections 281 and 106 (1) of the BNS, 2023. 3.The contention of the petitioner is that the petitioner sought the i)Viscera and chemical analysis report, ii)Spot Pamchanama, iii)Inquest Report, and iv)Detailed Postmortem Report, from the respondent to file a Motor Accident Claim Petition. As these documents have not yet been furnished, the present petition has been filed.
4.The learned Additional Public Prosecutor appearing for the respondent submitted that the investigation is now complete, and a charge sheet has been filed in P.R.C.No.12 of 2026 before the learned Judicial Magistrate I, Tambaram. He further submitted that the petitioner may file a copy application before the learned Judicial Magistrate I, Tambaram, to collect these documents which forms part of the charge sheet.
5.Considered the rival submissions and perused the materials available on record.
6.In view of the above submissions, the petitioner is directed to file a copy application before the learned Judicial Magistrate I, Tambaram, to obtain the aforesaid documents. The learned Judicial Magistrate I, Tambaram, shall not
raise any objection to this request, as the petitioner is seeking certified copies of the documents.
7.With the above directions, this Criminal Original Petition is disposed of.
