PRAYER: Writ Petition is filed under Article 226 of Constitution of India, praying for issuance of Writ of Mandamus, directing the 1st respondent to dispose of the petitioner's representation dated 21.06.2021, regarding, finding how the OSR land was conveyed to the petitioner through various registered documents, meanwhile how it could be registered by the 7thRespondent and to take necessary action against the 3rd to 6th Respondents who sold an OSR land to the Petitioner For Petitioner : Mr.R.Parasuraman For R1 & R2 : Mr.A.Gopinath Government Advocate (Crl.Side) For R7 : Mr.P.Balathandayutham Special Government Pleader

ORDER

This Writ Petition has been filed for a direction, directing the respondent to consider the representation submitted by the petitioner dated 21.06.2021 seeking fair investigation on the complaint lodged by the petitioner.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. On the complaint lodged by the petitioner, the District Crime Branch, Kancheepuram, originally, registered an FIR in Crime No.12 of 2021 for the offences under Sections 120(B), 465, 468, 471, 477(A), 420 r/w 34 of IPC as against the accused persons. Subsequently, the entire investigation was transferred to CBCID, Kancheepuram, on 22.07.2021 and the FIR was re-registered as Crime No.4 of 2021 for the offences under Sections 120(B), 465, 468, 471, 477(A), 420 r/w 34 of IPC and now the investigation is pending.

4. Pending investigation, the petitioner submitted a representation alleging several allegations as against the accused persons including the sale of property originally allotted for the Open Space Reservation area to the third parties. Subsequently, the said land was acquired for laying a road by the National Highways. However, the said representation has not been considered so far.

5. In view of the above, the Inspector of Police, CBCID, Kancheepuram, is directed to consider the representation submitted by

the petitioner and accordingly, to complete the investigation in Crime No.4 of 2021 and file a final report in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

6. With the above direction, this writ petition stands disposed of. No costs.
