PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to transfer the investigation of the case in crime No.133 of 2017 from the file of the 1st respondent police to the CBCID, Vellore District.

O R D E R

The prayer sought for in the present petition is to transfer the investigation in crime No.133 of 2017 from the file of the 1st respondent police to the CBCID, Vellore District.

2. The grounds, on which, the petitioner seeks transfer of investigation is that the respondent came to the conclusion that there was a possibility of suicide without conducting proper enquiry. The complainant has also not been enquired till date. In other words, according to the learned counsel for the petitioner, there is no such progress in the investigation.

3. In view of the apprehensions of the petitioner, I am of the view that the investigation should be monitored by a superior officer on a day to day basis instead of transferring the investigation.

4. In the result, the Criminal Original Petition stands disposed of with a direction to the first respondent to expedite the investigation in Crime No.133 of 2017 and complete the same within a period of three months from the date of receipt of a copy of this order. Such an investigation shall be monitored by the Deputy Superintendent of Police having jurisdiction over the first respondent.
