ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The present writ petition has been filed praying for a writ of Mandamus to direct the 2nd respondent and 3rd respondent to comply with the order passed by the 1st respondent in proceedings No.685 /2023 / A3 dated 24/11/2023 permitting delayed registration of death and consequently direct the 2nd and 3rd respondents to issue the death certificate of Mrs. Kannathaammal, W/o.Vellaisamy with in time frame fixed by this Court.

3. At the outset, learned counsel for respondents 1 and 2 would submit that there is already been a recommendation made by the first respondent vide proceedings dated 24.11.2023. On this being pointed out, learned counsel for the third respondent would submit that the petitioner may have to submit an online application. Agreed to by the learned counsel for petitioner.

4. While agreeing with the above submission of the third respondent, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, it is open to the petitioner to submit an online application to the respondent Authority along with documentary evidence. If any such on-line application is submitted by petitioner, the same shall be considered by the appropriate respondents, keeping in view the recommendation made by the first respondent vide proceedings dated 24.11.2023, on its own merits and orders shall be passed in accordance with law, after affording reasonable opportunity of hearing to petitioner and any other interested persons, within a period of four (4) weeks from the date of such on-line application. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the case on its own merits and in accordance with law.
