Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus direct the Respondents herein to correct the survey number as SF.No. 509/5 of Kattukottai Village Salem District instead of SF.No. 509/2 in the encumbrance certificate which relevant to the sale deed document dated 03.06.1983 registered by the second respondent in Document No. 1167 of 1983 by considering the representation of the petitioner herein dated 06.02.2024 and 27.03.2024 within the time fixed by this Court. ORDER

With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

2. This writ petition is filed to direct the Respondents herein to correct the survey number as SF.No.509/5 of Kattukottai Village Salem District instead of SF.No.509/2 in the encumbrance certificate as in the sale deed document dated 03.06.1983 registered by the second respondent in Document No. 1167 of 1983 by considering the representation of the petitioner herein dated 06.02.2024 and 27.03.2024 within the time fixed by this Court.

3. Heard learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents and perused the materials available on record.

4. The case of the petitioner is that he purchased the property in Survey No.509/5 in Kattukottai Village, Salem District. However, in the encumbrance certificate, it is reflected as if the survey No.509/2 is purchased. It is his contention that the said mistake has been committed by the authorities 2/4

concerned. In this regard, he has given representations to the respondents on 06.02.2024 and 27.03.2024 and the same has not been considered till date. Hence, the present Writ Petition.

5. Considering the limited prayer sought for in the Writ Petition, without going into the merits of this Writ Petition, the respondents are directed to consider the representations of the petitioner dated06.02.2024 and 27.03.2024 and pass Order on the same within a period of two months from the date of receipt of a copy of the Order.
