The petitioner, who was arrested and remanded to judicial custody on 12.04.2022 for the offences punishable under Section 174 of Cr.P.C. altered into Section 306 of IPC, Sections 5(1), 6 of POCSO Act r/w Section 4B(2) of TNPWH Act in crime No.5 of 2022 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the victim girl fell in love with the petitioner and they loved each other. Thereafter, he refused to marry her. Hence, she committed suicide.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of bail to the petitioner.

4. The learned Additional Public Prosecutor would submit that though the petitioner and the victim girl loved each other, thereafter, he refused to marry her. Hence, she committed suicide.

5. It is seen that the petitioner fell in love with the victim girl aged about 17 years. He also had penetrative sexual assault on her. Thereafter, he refused to marry the victim girl. He also used to get money from the victim girl on several times. Thereafter, he refused to marry the victim girl and as such, she committed suicide. Therefore, the petitioner has committed very serious and heinous offence as against the minor victim girl and this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this criminal original petition is dismissed. 05.07.2022 lok
