O R D E R

This Court has already allowed the appeal dated 17.02.2010 directed the respondent is found guilty under Section 138 of Negotiable Instruments Act for questioning the quantum of sentence and the matter was directed to be listed on 24.02.2010 for appearance of the respondent. Subsequently, the matter was not listed on 14.02.2010. On 01.02.2018, when the matter was taken up for hearing, this Court directed the Inspector of Police, Mettupalayam, Coimbatore District to secure and produce the accused before this Court on 14.02.2018. Subsequently, the matter was taken up in the special sitting on 24.02.2018, this Court directed the learned Public Prosecutor to comply with the order passed by this Court on 14.02.2018 and again the matter was listed on 07.03.2018. On 07.03.2018, there was no compliance of the earlier order dated 14.02.2018 and the learned Government Advocate was directed to give suitable instructions to the Inspector of Police and to produce the accused before this Court on 08.03.2018.

2. Today, i.e. on 09.03.2018, the matter is taken up for hearing, the Inspector of Police, Mettupalayam, Coimbatore District is present before this Court and the appellant and his counsel also present before this Court. It is informed by the learned counsel for the appellant that the matter was already settled between the parties.

3. Recording the said submission, the earlier order passed by this Court dated 17.02.2010 was recalled and hence, this criminal appeal is closed.
