ORDER
This writ petition has been filed by the petitioner seeking to dispose of the representation of the petitioner dated 28.03.2025, whereby, he sought to grant compensation against unsold/OSR land acquired from the petitioner for the industrial purpose.
2.Mr.N.R.Elango, learned Senior Counsel for Mr.A.S.Aswin Prasanna, learned counsel for the petitioner would submit that the issue involved in this Writ Petition is no more res integra in view of the order passed by the Hon'ble Division Bench of this Court in W.P.Nos.33522 and 33530 of 2018 dated 13.03.2024.
3.Mr.J.Ravindran, learned Additional Advocate General assisted by Mr.A.Selvendran, learned Special Government Pleader appearing for the respondents 1 to 5 would submit that the 5 th respondent would consider the petitioner's representation dated 28.03.2025 in the light of the order passed by the Hon'ble Division Bench of this Court in W.P.Nos. 33522 & 33530 of 2018 dated 13.03.2024.
4.In view of the above submissions, it is evident that the issue regarding the disbursement of compensation for the OSR land has already been decided by the Hon'ble Division Bench of this Court in W.P.Nos. 33522 & 33530 of 2018 dated 13.03.2024. For better appreciation, paragraph No.4 of the aforesaid writ petitions is reproduced hereunder:- "4.Precisely, the question raised in the present writ petitions is adjudicated by the Apex Court in the case of Association of Vasanth Apartments, supra. The questions posed before the Apex Court were - (i) Who would be entitled to the compensation if a gift is made in terms of the impugned Rule/Regulation?; and, (ii) What would happen if the OSR area is acquired in the exercise of the power of eminent domain for the public purpose?. The Apex
Court held that the gift under Rule/Regulation is intended only to ensure due compliance with the requirement of the OSR area being effected and to prevent misuse by the owner. Upon acquisition by the Government, the owner would be entitled to the compensation."
5.In the light of the above, the 5 th respondent is directed to dispose of the petitioner's representation dated 28.03.2025, taking into consideration of the order passed in the writ petitions in W.P.Nos. 33522 & 33530 of 2018 dated 13.03.2024, within a period of four weeks from the date of receipt of a copy of this order.
