Prayer: Writ Petition filed under Article 226 of Constitution of India, seeking for an issuance of writ of Mandamus, to direct the respondents 1 to 4 to appoint the petitioners for the post of Multi purpose Hospital Worker in any Primary Health Center in Thiruvannamalai District as per the Seniority list dated 29.08.2024 issued by the 3rd respondent within the stipulated time in accordance with law.

ORDER

The instant writ petition has been filed to direct the respondents 1 to 4 to appoint the petitioners in the post of Multi Purpose Hospital Worker in any Primary Health Center in Thiruvannamalai District as per the Seniority list dated 29.08.2024.

Learned Counsel for the petitioners would submit that petitioners were appointed as Sanitory Workers during 2008 and subsequently by virtue of the order in W.P.No.22146 of 2019, the respondents were directed to extend the benefit of G.O.(D).No.792 dated 05.04.2017. Thereafter, the respondents have published the seniority list, wherein the petitioners were placed at Sl.No.11 and 14 respectively.

Subsequent to the seniority list, the respondents terminated the services of 7 persons by virtue of the order dated 27.11.2024. However, after terminating their services, the seniority list was not amended. When this Court put a pertinent question to the learned Counsel for the petitioner, whether those 7 persons were placed either above the petitioner or below the petitioner, the learned Counsel has no clear answer. However, Mr.E.Sundaram, the learned Government Advocate who takes notice for the respondents 1 to 4 would submit that those 7 persons are placed below the petitioner.

Therefore, this Court is of the view that the petitioners were no way affected by the termination of those 7 persons. In view of the same, this Court do not find any merits in the instant writ petition. 6.

In the result, the Writ Petition stands dismissed as devoid of merits. However, the petitioners are given liberty to make appropriate representation to the Authority Concerned within a period of two weeks from

the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed.
