( Civil Appellate Jurisdiction ) Monday, the Fourteenth day of December Two Thousand Twenty PRESENT The Hon`ble Mr Justice V.SIVAGNANAM CMP No.11269 of 2020 in CRP.NPD.NO.3076 OF 2019 A.SASIKALA [ PETITIONER ] Vs S.SUDHAKAR [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to permit the petitioner to withdraw a sum of Rs.3,60,000(Three lakhs and sixty thousand)deposited before the Additional Subordinate Court Hosur, Krishnagiri in I.A.No.44/201 in HMOP.No.42/2017.(in CMP.No.11269/2020 in CRP.NPD.NO.3076 OF 2019) Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.P.

ARAVINDHAN Advocate for the petitioner and of on behalf of the Respondents the court made the following order:- The learned counsel for the petitioner submitted that this Court directed the respondent in C.M.P.No.19881 of 2019 to deposit 50% of arrears of maintenance i.e., Rs.3,60,000/- and the amount has been deposited in the trial Court on 23.09.2019. When the petitioner approached the trial Court for withdrawal of the amount, the same was rejected by the trial Court on the ground that there is no permission from this Court to withdraw the amount.

The learned counsel for the respondent submitted that in the trial Court, counsel are taking steps for settlement and he had no objection to withdraw 50% of the arrears of maintenance deposited in the trial Court.

The aforesaid submission of learned counsel for the respondent is recorded. The Civil Miscellaneous Petition is allowed. https://hcservices.ecourts.gov.in/hcservices/

The petitioner is permitted to withdraw 50% of the arrears of maintenance deposited in the trial Court.
