Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of Certiorarified mandamus calling for the records relating to the impunged order of the respondent herein rejecting the petitioner's application No.80 3000 570 (downloading in website dated 04.06.2018) and quash the same and direct the respondent herein to permit the petitioner to participate in the selection process for the post of Motor Vehicle Inspector Gr. II (Post code 2119) pursuant to Notification No.03/2018 dated 14.02.2018.

ORDER

The grievance of the petitioner in this writ petition is that though in pursuance to the advertisement made by the sole respondent for the post of Motor Vehicle Inspector Grade II, he made an application fulfilling all the criteria including the criteria of Driving License as stipulated in the advertisement. However, he was not given with hall ticket and his application has been rejected on the ground that he was not possessing the driving license as required. According to the petitioner, his application form has been illegally rejected. The petitioner has made this prayer to direct the respondent to permit the petitioner to participate in the selection process for the post of Motor Vehicle Inspector Grade II.

The learned counsel appearing for the petitioner would submit that since he is qualified and having a valid license, the rejection of his application on the said ground was without any substance and as such, the respondent be directed to permit him to sit in the examination which is going to be held on 10.06.2018, pending disposal of the writ https://hcservices.ecourts.gov.in/hcservices/

Mr.M.Loganathan, learned standing counsel appearing for the Tamil Nadu Public Service Commission/respondent would submit that the petitioner's application was rejected as he had not furnished the required driving license as required. In this regard, the learned counsel appearing for the respondent has drawn the attention of this Court to a document submitted by the petitioner obtained from the Licensing authority indicating that the petitioner's license was valid up to 19.04.2008 and as such, the petitioner has no case. 4.

Considering the fact that the document submitted by the petitioner himself issued by the appropriate licensing authority indicating that the petitioner license was valid up to 2008 and the same is not in terms of advertisement and as such, the petitioner cannot be said to be possessing the qualification with regard to driving license as prescribed in the advertisement made. Hence, I am of the view that the petitioner has made out no case in this writ petition and as such, this Court dismiss this writ petition at the stage of admission. Accordingly, the same stands dismissed. However, no order as to costs. Consequently, the connected miscellaneous petition is also closed.
