This Civil Miscellaneous Petition has been filed seeking to condone the delay of 145 days in payment of deficit court fee of Rs.12/- in the above appeal.
2. Mr.C.Senapathi, learned counsel for petitioner submitted that the above civil miscellaneous appeal was presented on 26.02.2024 and the Registry has returned the same for rectification of deficit court fee on 06.03.2024 and the same was complied with the court fee on 16.07.2024. As the appellant is a Government owned public transport and due to administrative purposes, proper court fee was not paid in time. Hence, there is a delay of 145 days in the said payment arose and the said delay caused is neither willful nor wanton, but for the above said reasons. Accordingly, he has filed the above petition.
3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit seems to be justifiable one, this court is inclined to allow this petition.
