Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the 2nd and 3rd respondents to consider the application dated 29.03.2026 and consequently to direct the 4th respondent to provide adequate police protection to 2nd and 3rd respondents while survey and demarcate the boundaries of petitioners land in survey No.80/2 measuring an extent of 1.11.00 Hectares (274 cents) and survey No.81/2 measuring an

ORDER

This writ petition has been filed to direct the respondents to consider the petitioner's application dated 29.03.2026.

2. Mr.B.Pachaiyappan, learned Government's counsel, takes notice on behalf of the respondents.

3. By consent of the parties, the main petition is taken up for disposal in the stage of admission itself.

4. The learned counsel for the petitioner would submit that in this case, the petitioner filed an application dated 29.03.2026 before the 2nd & 3rd respondents, requesting to conduct survey and lay boundary stones at the subject land. However, the said representation was not at all considered by the 2nd & 3rd respondents till date. Hence, this petition.

5. In reply, the learned counsel for the respondent would submit that the petitioner's representation will be disposed of within a period of 12 weeks and hence, he requests this Court to pass appropriate orders.

6. Heard the learned counsel appearing for the petitioner as well as the respondent and also perused the entire materials available on record.

7. In view of the above, without expressing any opinion on the merits of the matter, this Court directs the 2nd respondent to consider the application of the petitioner dated 29.03.2026 and after issuing due notice to all the concerned parties, dispose of the same, on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order.

8. It is made clear that this order is passed only for the purpose of issuing a direction to the official respondent for conducting survey and laying boundary stones at the subject land. If there is any dispute with regard to the possession over the said property, the same has to be decided only by way of filing a suit before an appropriate Civil Court.

9. If any police protection is required at the time of conducting survey, the official respondents are granted liberty to avail the same by approaching the

4th respondent. In such case, the 4th respondent shall provide all necessary protection to the respondents till the completion of survey at the subject land.
