PRAYER: This criminal original petition has been filed under Section 483

(1) (b) of BNSS, pleased to modify the condition as "Two (Blood Relative) sureties instead of "One Government Surety" which is imposed by the Lower Court in pursuance with order dated 19.03.2025 made in Crl.M.P.No.797 of 2025 pending on the file of the Chief Judicial Magistrate, Chengalpet.

ORDER

Petitioner who was granted bail for the offences under Section 304 (ii), 120 B, 326, 324, 201 r/w 109 I.P.C. Section 7 (a), 4 (1) (i), 4(1-A), 14 (A), 4 (1) (aaa) of Tamil Nadu Prohibition Act Section 7 of Tamil Nadu Denatured Spirit, Methyl Alcohol and Varnish (French Polish) Rules, 1959, by the learned Judicial Magistrate, Chengalpet, has sought for modification of the following condition:- 1.The petitioner shall execute a bond for a sum of Rs.1,00,000/- also with two sureties of which one surety must be a Blood relative of petitioner and official surety-1 (Tamil Nadu State Government Employee) for like a sum. 2.The learned counsel for the petitioner would submit that petitioner belongs to a very poor family and he is a daily wage worker; that he is unable to arrange a Government surety who is earning Rs.

1,00,000/- and also offer a blood relative worth Rs.1,00,000/- as a surety and that though the bail order was granted on 19.03.2025, the petitioner is still in jail and sought for modification of the aforesaid condition. The learned counsel further submitted that the petitioner is willing to offer a Government servant as a surety and the value of the bond may be reduced. Page No.

3.Heard the learned Government Advocate who submitted that all the co-accused similarly placed were released on bail on the same condition and no indulgence is required in respect of this petitioner. 4.Heard the learned counsel for the petitioner and the learned Special Public Prosecutor (for CBI Cases) for the respondent and perused the records 5.Though the petitioner was granted bail on 19.03.2025, he is still languishing in jail since, he is unable to comply with the aforesaid condition. Considering the said fact and the fact that he is willing to offer Government servant as surety, this Court is inclined to modify the first condition and impose the following condition:- i)the petitioner shall execute a bond for Rs.20,000/- with two sureties; one surety will be a blood relative and the other a Government Servant. 6.The other condition imposed by the learned Judge shall remain unaffected.
