ORDER
This Criminal Original Petition has been filed, seeking to direct the 1st respondent police not to harass the petitioner in the guise of enquiry on the 2nd and 3rd respondents' complaint.
2. The learned counsel for the petitioner submitted that, the petitioner is running a two-wheeler mechanic shop at Krishnasamy Mudaliyar Street, Ponneri, Ponneri Taluk, Chennai. It is also submitted that, the counter petitioners/respondents 2 and 3, namely, Elil Basha and Adamsha are running their business near the petitioner's shop and they were frequently picking quarrel and causing trouble to him. On 09.04.2026 at about 9.00 a.m., the said persons allegedly abused the petitioner in filthy language and assaulted him with an iron rod. Thereafter, the petitioner was admitted to the Government Hospital, Ponneri, where he received treatment and an Accident Register was issued. Based on his complaint, C.S.R.No.78 of 2026 was registered. However, no further action was taken by the police.
3. The learned counsel for the petitioner further submitted that, as a counterblast to his complaint, a false complaint was lodged against him alleging that he, along with 10 others, had created trouble for the counter
complainant/respondents 2 and 3 and C.S.R.No.77 of 2026 has been assigned. He further contented that, the petitioner had sustained grievous injuries including injuries to his face, for which sutures made, and that he continues to suffer severe pain in his shoulder.
4. The learned Government Advocate (Crl. Side) appearing for the first respondent police submitted that, C.S.R.No.78 of 2026 was registered based on the complaint given by the petitioner and C.S.R.No.77 of 2026 was registered based on the complaint given by the counter complainants. He further submitted that enquiries were conducted in both C.S.R complaints and that both the C.S.Rs have been closed.
5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the first respondent and also perused the materials available on record.
6. Considering the above submissions made by the learned counsel on either side and on perusal of the medical records, it is seen that the petitioner had sustained injuries on his face, for which sutures made. The medical records issued by the Government Hospital, Ponneri, substantiated the same.
7. In such circumstances, this Court finds that the closure of C.S.R.No.78 of 2026 does not appear to be proper. Therefore, the first respondent is directed to conduct an appropriate enquiry and file a final report, within a period of two months from the date of receipt of a copy of this order.
8. With the above direction, this Criminal Original Petition stands disposed of.
