Due to previous enmity, two groups had clashed in a funeral procession leading to registration of two complaints as case and case in 1/4

counter. The petitioner herein been shown as 4th accused in the counter case registered in FIR No.116 of 2024.

The learned counsel appearing for the petitioner submitted that to counter blast the earlier complaint registered in FIR No.115 of 2024, the present complaint been lodged by including innocent persons including the petitioner herein who is the Government servant employed elsewhere. He came to the village to attend the funeral and he has nothing to do with the alleged incident, which is the subject matter of investigation in Crime No.116 of 2024.

The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that being the case and case in counter the investigation been taken up in accordance with procedure and final report will be filed within a period of two months by following the Police Standing Order and the dictum of this Court in respect of case and case in counter.

Taking note of the above submissions and the submissions 2/4

made in the complaint against this petitioner, this Court is of the view that with the material available, the Court cannot pre-conclude regarding the involvement of the petitioner herein and therefore, dismissing the Criminal Original Petition to quash the First Information Report with direction to the respondent police to complete the investigation within a period of two months in the course manner known to law.
