ORDER

This Criminal Original Petition has been filed seeking a direction to third respondent not to harass the petitioners based on the false complaint without any due process of law.

2. The petitioners are estranged mother-in-law and sister-in-law of the defacto complaint, namely Sonali. According to the petitioners, the first petitioner's son Bhargav married the said Sonali on 20.01.2023. Subsequently, both the Bhargav and Sonali went to United States but lived in different states. The said Bhargav was residing in Virgina and Sonali was living in Texas. It is stated that neither of the petitioners visited them in the United States. After some time, they developed some misunderstanding and her daughter-in-law made a complaint against the petitioners before the NRI Cell and the same was forwarded to the third respondent Police Station. The third respondent Police called the petitioners to settle the issue on the terms of Sonali. The Sonali also filed a divorce petition in HMOP.No.259 of 2025 before the Family Court, which is pending.

3. Considering the above facts and circumstances, this Court directs the respondent Police not to unnecessarily disturb or harass the petitioners as it is

purely a matrimonial dispute between the parties and a divorce petition is already pending before the Family Court. However, if any tangible material is available and an enquiry is necessary, the third respondent issue summons to the petitioners and thereafter call them for enquiry.

4. With the above directions, this Criminal Original Petition is disposed of.
