O R D E R
(The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 8 (c ) and 20 (b) (ii) (B) of NDPS Act in Crime No.1360 of 2020, on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner along with other accused was in possession of 1.3 Kg of Ganja. Hence, the complaint.
3. The learned Counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would further submit that based on the confession of A1, he has been falsely implicated in this case. Hence, he prays for grant of Anticipatory Bail to the petitioner.
4. The learned Additional Public Prosecutor would submit that the petitioner was found to be in illegal possession of 1.3 Kg of Ganja. He would further submit that there are three previous cases pending as against the 2/4
petitioner. Earlier this Court dismissed the Anticipatory Bail petition in Crl.O.P.No.13405 of 2020 dated 01.09.2020. Hence, he opposed the grant of anticipatory bail to the petitioner.
5. Taking into the consideration of the facts and circumstances of the case and also the fact that the petitioner has three previous cases, this Court is not inclined to grant Anticipatory Bail to the petitioner.
