ORDER
The present Writ Petition has been filed seeking the issuance of a Writ of Writ of Certiorarified Mandamus to call for the records relating to the impugned order passed by the 3rd respondent in his proceedings Oo.Mu.No. 4673/A2/2025 dated 14.11.2025 and Oo.Mu.No. 5840/A2/2025 dated 19.12.2025 and quash the same and the directing the respondents to grant permission to fill up the post of Secondary Grade Teacher to the petitioner school and consequently approve the appointment of the Secondary Grade Teacher.

The learned counsel for the petitioner submitted that the petitioner, Gandhi Aided Elementary School is a Government-aided institution governed by the Tamil Nadu Private School Regulation Act, 1973. The post of Secondary Grade Teacher had been vacant due to superannuation of one N.Mala on 31.05.2023. Despite multiple proposals sent by the school management between
April 2025 and December 2025, the 3rd respondent repeatedly returned the applications (via proceedings dated 14.11.2025, and 19.12.2025), asserting that the vacancy must be filled using surplus teachers from other schools. Following a subsequent inquiry by the 4th respondent on 30.12.2025, regarding deployment willingness, the school management formally replied on 03.01.2026, expressing their unwillingness to absorb surplus staff from external institutions and requesting independent recruitment permission; however, as no administrative orders have been passed till date, the petitioner has approached this Court for relief.
3. The learned counsel for the petitioner further submitted that subsequent to the impugned order, the petitioner-School also submitted an explanation to the second respondent, which remains pending. Hence, the petitioner prays for a direction to the second respondent to pass appropriate orders on the said explanation.
4. Heard the learned counsel appearing for the petitioner and the Government Advocate appearing for the respondents and perused the materials placed before this Court.

Considering the facts and circumstances of the case and the submissions made on either side, this Court directs the 2nd respondent / District Educational Officer, Tirukoilur, to consider the explanation submitted by the petitioner-School and pass appropriate orders, on merits and in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order.
6. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
