ORDER
This petition has been filed seeking a direction to the respondent to issue a Non-availability certificate of the petitioners birth certificate in exercise of the power conferred under section 17 of Registration of Births and Deaths Act 1969 and on the corresponding Rule 13(3) of the Tamilnadu Registration of Birth Rules 2000 by considering the petitioners representation dated 17.2.2026.
2. It is the case of the petitioner that he was born on 09.03.1991 in Srinivas Priya Hospital Private Limited, No.89 Patel Road, Perambur, Chennai. His birth was not intimated to the respondent, due to which, he was not furnished with his birth certificate. He has been informed to furnish his birth certificate by his superior officer. For the delayed registration of his birth, he needs the application accompanying the non-availability certificate to the Revenue Divisional Officer as per G.O.Ms.No.324, dated 28.06.2023 for the years on which year the birth and death have occurred, for the preceding one year of occurrence of Birth Death and for the succeeding one year of occurrence of Birth Death. Therefore, the petitioner made a representation on 17.02.2026 to the respondent by stating the above facts and sought to issue a Non Treaceable Certificate of his birth certificate, which was kept in abeyance without attending the same by the respondent. Hence, the petitioner filed the present writ petition.
3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.
4. The learned Standing Counsel appearing for the respondent submitted that the representation will be considered and orders will be passed within the stipulated time as fixed by this Court.
5. Heard the learned counsel for both side and perused the materials available on record.
6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the respondent to consider and pass orders on the petitioner's representation dated 17.02.2026. within a period of six weeks from the date of receipt of a copy of this order.
