The petitioner/A1 in S.C.No.118 of 2024, who is facing trial for the offences punishable under Sections 380, 302 of I.P.C. @ 380, 302, 201, 449 of I.P.C. in Crime No.252 of 2024, had filed this bail application. 1/4

2.The case of the prosecution is that the petitioner along with other accused alleged to have committed murder of the de-facto complainant's mother and stolen 11 sovereigns of gold. Hence, the case. 3.The contention of the learned counsel for petitioner is that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. The petitioner was arrested in this case on 03.06.2024. He further submitted that in this case investigation completed, charge sheet filed and the case is pending for trial. The petitioner is arrayed as A1 and now he has to make preparation for defending the case. Hence, prayed for granting bail to the petitioner.

4.The learned Government Advocate (Crl. Side) appearing for the respondent police strongly opposed for granting bail to the petitioner stating that it is a murder for gain. The petitioner along with other accused trespassed into the deceased house and committed murder. Further the petitioner has got 18 previous cases of theft.

6.Considering the facts and circumstances of the case, the submission made by the learned counsel appearing on either side and taking note of the fact that the petitioner has got 18 previous cases, this Court is not inclined to entertain this petition.
