Learned counsel for the appellant contended that the 1st respondent died on 03.09.2020 and that the sole appellant, who is the son of the 1st respondent, is the only legal heir of the deceased 1st respondent and that the same may be recorded. She has also filed a memo to that effect. The said memo is recorded.
2.The learned counsel for the respondents did not raise any serious objection and this Court is satisfied with the reasons assigned in the affidavit filed in support of this petition. Hence, the petition is allowed. 3.The Registry is directed to carryout necessary amendments in the Second Appeal No.361 of 2007 and list the matter for final hearing after four weeks.
