This petition has been filed seeking to cancel the anticipatory bail granted to the 1st respondent/accused in Crime No.434 of 2023 which had been registered under Sections 403, 406, 420, 469 and 471 of IPC. 2.

This Court had granted anticipatory bail and had directed that the 1st respondent/accused should deposit a sum of Rs.7,00,000/- to the credit of Crime No.434 of 2023 before the V Metropolitan Magistrate, Egmore, Chennai. The amount had been deposited and receipt had also been produced before this Court. It had also been recorded in the Court that it had been so deposited on 15.10.2023. It is also seen from the records that after completing investigation, the Investigating Officer has also filed final report before the said Court.

It is the grievance of the learned counsel for the petitioner that the 1st respondent is not appearing before the Trial Court. That is an issue which the Trial Court will have to take note of and I am confident that necessary steps would be taken in that regard. It is also contended that the sureties had 1/3

not been executed. Again, that is an issue which will have to be examined only by the learned Trial Court and this Court has only got to examine whether the condition imposed namely to deposit Rs.7,00,000/- has been satisfied or not. It has been complied with. Hence, I am not inclined to cancel the anticipatory bail granted to the petitioner by order dated 20.10.2023 in Crl.O.P.No.20700 of 2023. Thus the Criminal Miscellaneous Petition stands dismissed.
