PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, to direct the respondents 1 to 5 to take suitable action for mutation of revenue records pertaining to the property situated at Survey Nos.90/19, 90/20 & 90/23 measuring 0.46 cents at Erumboor Village, Vandavasi Taluk, Tiruvannamalai District based on the representation of the petitioner dated 22.01.2025 in a time bound manner and pass orders. ` For Petitioner(s) : Mr.B.Eswaran for M/s.Swaraj Associates For Respondent(s) : Mr.P.Sathish Additional Government Pleader

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The present writ petition is filed praying for a writ of mandamus, to direct the respondents 1 to 5 to take suitable action for mutation of revenue records pertaining to the property comprised in Survey Nos.90/19, 90/20 & 90/23 measuring an extent of 0.46 cents situated at Erumboor Village, Vandavasi Taluk, Tiruvannamalai District based on the representation of the petitioner dated 22.01.2025 in a time bound manner.

It is submitted by the learned counsel for the petitioner that the petitioner's husband executed a settlement deed dated 06.02.2006 in Document No.238 of 2006 before the SRO, Vandavasi in favour of the petitioner, in respect of the subject property. Thereafter, the petitioner filed representation dated 22.01.2025 before the respondents seeking mutation of revenue records in respect of subject property, in her favour based on the said settlement deed. However, the said representation was not considered by the respondents till date. Aggrieved by the same, the petitioner has come up with the present writ petition.

On this being pointed out, the learned Additional Government Pleader would submit that the petitioner has not taken out an online application for issuance of patta, if an online application is taken out, the respondents would consider the same and appropriate orders would be passed, within a time frame to be fixed by this Court, which was agreed to by the learned counsel for petitioner.

In view thereof, it is open to the petitioner to file an online application and if any such online application is filed by the petitioner, the respondents shall consider the same on its own merits and pass appropriate orders in accordance with law, after affording reasonable opportunity of hearing to the petitioner, and 3/6

any other interested persons/stake holders, within a period of sixteen (16) weeks from the date on which the online application is filed by the petitioner. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the case on its own merits and in accordance with law.
