ORDER

(Order of the Court was made by S.S.SUNDAR, J.) This suo motu contempt proceedings was initiated as per the order of the learned single Judge dated 16.09.2022 in Cont.P. Nos.907 and 908 of 2022. It is to be seen that simultaneously, Registry earlier initiated suo motu contempt in Suo Motu Contempt 1/4

Petition No.1268 of 2022 for the disparaging remarks the contemnor had made against a learned single Judge of this Court and after accepting the unconditional apology tendered by the contemnor, the same was closed by order dated 22.11.2022. This contempt petition was also simultaneously initiated for making some remarks in the corridor of the Court. The contemnor has filed an affidavit and in paragraphs 2 and 3 of the said affidavit, the contemnor has stated as follows:

'2. Without any reservation whatsoever, I reiterate my unconditional apology for the contemptuous indiscretion I committed during the court proceedings. Wholeheartedly I regret my conduct, so despicable, so reprehensible. I realize if only I had consulted a senior member of the bar, I would certainly not have committed this perfidy.

3. I fervently appeal to this Hon'ble Court for mercy. I have learnt my life's lesson. I make this solemn assurance that, at no time in future, will I give occasion for cause for any complaint of misdemeanours or misconduct in the discharge of my duty as an advocate. In all actions of mine as a lawyer, I will endeavour to uphold the dignity and respect of the legal profession I promise, in all humility and with utmost emphasis, that I will not be responsible for any act which will expose me for action for contempt of court.'

2. From the extracted portion of the affidavit filed by the 2/4

contemnor, this Court is convinced that the contemnor has wholeheartedly expressed his regret for his conduct. Therefore, this Court is convinced that the contemnor has sincerely tendered his unqualified and unconditional apology. Hence the contemnor is purged of contempt and this contempt petition stands closed. (S.S.S.R., J.) (S.M., J.) 13.12.2023 Index : Yes / No mmi 3/4
