ORDER

This writ petition has been filed seeking a writ of mandamus directing the respondents to grant retrospective promotion, refix his seniority and extend consequential service and monetary benefits to the petitioner.

2. The petitioner was eligible for promotion to the post of Regional Transport Officer in the 2012-2013 panel, but his name was omitted due to pending disciplinary proceedings. Though his immediate junior was promoted, the petitioner was subsequently fully exonerated and the charges against him were dropped by G.O.(D).No.560 dated 06.06.2019. Despite recommendations for retrospective promotion and restoration of seniority, no orders were passed. Consequently, his seniority was not revised, adversely affecting his further promotional prospects, including consideration for promotion to the post of Deputy Transport Commissioner. Further, the petitioner submitted representations to the respondents. However, no action has been taken so far. Hence, the present writ petition.

3. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents.

4. Considering the facts and circumstances of the case, without going into the merits of the case, the first respondent is directed to consider the petitioner's representation, which was received by the respondents on 07.04.2025 taking note of the recommendation of the Additional Chief Secretary/Transport Commissioner, Chepauk, Chennai dated 24.03.2021. and pass appropriate orders on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order.

5. With the above directions, this writ petition is disposed of. No costs. 04-06-2026 Index: Yes/No Speaking/Non-speaking order MRP
