Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for a writ of Mandamus directing the first respondent to consider my review application dated 10.09.2015. Within a time frame fixed by this court.

ORDER

By consent, the writ petition is taken up for final disposal.

The petitioner, while working as a Salesman in Andhiwadi Shop No.3018, Hosur Taluk, run by the Tamil Nadu State Marketing And Corporation [TASMAC], was visited with disciplinary proceedings, which ultimately ended in termination from service, vide order of the 3rd respondent dated 27.04.2015 and the appeal filed by the petitioner before the 2nd respondent has also ended in dismissal on 25.08.2015 and challenging the same, the petitioner filed a review application/petition dated 10.09.2015 before the 2nd respondent and since no orders have been passed, he came forward to file this writ petition.

Heard the learned counsel for the petitioner and Mr.S.Muthuraj, learned counsel who accepts notice on behalf of the respondents, who would submit that since no acknowledgment is available as to the submission of the review application/petition to the 1st respondent, the petitioner may be directed to submit fresh review application to the 1st respondent.

This Court, considering the limited scope of prayer sought for by the petitioner and in the light of the above facts and circumstances, permits the petitioner to submit a fresh review application/petition to the 1st respondent by enclosing a copy of this order as well as the copy of the earlier review petition within a period of two weeks from the date of receipt of a copy of this order and on receipt of the same, the 1st respondent is directed to consider the same on merits and in accordance with law, if the papers are otherwise in order and without putting the issue of limitation and pass orders within a further period of six weeks thereafter and communicate the decision taken, to the petitioner. The writ petition is disposed of accordingly. No costs.
