ORDER

This Criminal Original Petition has been filed seeking a direction to the learned Judicial Magistrate-I, Poonamallee, to expedite the proceedings in C.C.No. 245/2024 arising out of Crime No. 18 of 2023, pending before the

learned Judicial Magistrate-I, Poonamallee, and to complete the same within a time frame.

The petitioner, who is the defacto complainant, lodged a complaint and based on which, a case in Crime No.18 of 2023 was filed for the offence under Sections 419, 420, 465, 467, 468, 471, 120B of IPC. On completion of investigation, now charge sheet has been filed and the case has been taken on file as C.C.No. 245 of 2024. It is seen that 22 witnesses have been cited in the charge sheet. The petitioner seeks a direction for expeditious disposal of the case.

3. The learned Government Advocate (Crl. Side) submitted that there are nine accused in this case and all of them are appearing before the Trial Court. He further submitted that the petitioner has filed a petition under Section 319 Cr.P.C. before the Trial Court to add one more person as an accused.

4. The learned Government Advocate (Crl. Side) further submitted that the petitioner has lodged another complaint against the same set of persons, resulting in registration of Crime No.48 of 2025 for the offence under Sections 420 and 471 IPC. It is informed that in the said case, investigation is going on and it it will take six months to file the file final report. It is also submitted that there is substantial overlap in the evidence and materials in both cases. Hence, it

would be appropriate that both cases are tried together (though separately), so as to avoid conflicting findings and to ensure proper appreciation of evidence.

In view of the above submissions, this Court is of the considered opinion that, upon filing of the final report in Crime No.48 of 2025, the Trial Court shall take appropriate steps to conduct the trials in both cases simultaneously, but separately, in accordance with law. The Trial Court is further directed to make every endeavour to dispose of both cases as expeditiously as possible, preferably within a period of one year from the date of filing of the final report in Crime No.48 of 2025.
