O R D E R

The Criminal Appeal Case has been filed against the conviction and sentence imposed in judgement dated 04.12.2003 made in S.C.No.128 of 2003 on the file of the Additional District Sessions Court/ Fast Track Court No.III, Namakkal. He stood charge for the offence under Sections 451,324 IPC and Section 3 (1) of Tamil Nadu Properties (Prevention of Damages & Loss), the trial Court convicted under Section 451 IPC and sentenced him to undergo rigorous imprisonment for 2 years and https://hcservices.ecourts.gov.in/hcservices/

to pay a fine of Rs.500/- in default to undergo rigorous imprisonment for 6 months and convicted under Section 324 IPC and sentenced him to undergo rigorous imprisonment for 1 year and convicted under Section 3 (1) of Tamil Nadu Properties (Prevention of Damages & Loss) and sentenced him to undergo rigorous imprisonment for 4 years and to pay a fine of Rs.500/- in default to undergo rigorous imprisonment for 6 months. Now, challenging the said conviction and sentence, the appellant is before this Court with this criminal appeal.

2. Today, when the matter was taken-up for hearing, the learned counsel appearing for the appellant submits that pending appeal, the sole appellant died and he also filed a memo to that effect.

3. The learned Government Advocate (Crl. Side) appearing for the respondent on verification submits that pending appeal, the sole appellant died.

4. In view of the submission and based on the memo filed by the learned counsel for the appellant, this Criminal Appeal is dismissed as abated.
