The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 3(2) a, 4(1), 5(1)a of Immoral Traffic Prevention Act, 1956 in Crime No.52 of 2023, seeks anticipatory bail.

2. The case of the prosecution as per the defacto complainant is that the petitioner along with other accused has indulged in prostitution . Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent and he has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent would submit that the petitioner along with other accused

found to be indulged in prostitution. He would further submit that the petitioner is a habitual offender and he has got two previous cases of similar nature. Hence, he would vehemently oppose to grant anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on records including the FIR.

6. Taking into consideration the facts and circumstances of the case, and the submissions made by both counsel and also taking note of the fact that the petitioner has got two previous cases of similar nature, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. 12.06.2023 Vv
