The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 420, 120B, 109, 506(2) of I.P.C. in Crime No.2 of 2023 on the file of respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the 1st accused is running a company under the name and style of M/s.Euronexus Immigration Limited and sending job aspirants to abroad, thereby promised the defacto complainant to secure a job in abroad and received a sum of Rs.7 lakhs from him, but he neither secured a job nor repaid the amount. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is ranked as A5 and he is only an employee under A1. He would

submit that he is no way connected with alleged job racketing said to be committed by A1. He would submit that he has not at all committed any offence as alleged by the respondent police and he is no way connected with the occurrence. He would submit that the respondent police foisted a false case against him and there is no previous case pending against him. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for respondent would submit that he along with other accused have cheated nearly 27 victims for nearly about Rs.1,29,00,000/-. He would also submit that even the condition imposed for A1 by this court also not complied by him and if he is released on bail, he will tamper the evidence. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the above fact and circumstances of the case and also considering both side submissions and the fact that even the condition imposed by this court for A1 to deposit some amount, he has not complied the same and also the fact that the petitioner along with other accused have

cheated for nearly 27 victims, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
