The petition is filed to condone the delay of 175 days in re-presenting the above appeal.

2.Learned counsel appearing for the petitioner submitted that due to inadvertence of the counsel for the petitioner, the appeal filed in time could not be re-presented and as a result there was a delay in re-presentation.

3.Since no litigant can be put to suffer due to error committed by the counsel, this petition is allowed and the delay in re-presentation is condoned subject to the payment of costs of Rs.2,000/- to be payable by the petitioner to the Tamil Nadu State Legal Services Authority, Chennai within a period of two weeks from the date of receipt of a copy of this order, failing which the petition will be dismissed automatically without any further reference to this Court.
