This petition has been filed to direct the 2nd respondent to register a case on the complaint dated 04.03.2016 given by the petitioner.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. It is seen that this petitioner's daughter Pushpalakshmi got married to Prasanna Venkatesh (A1) on 20.05.2015 and that she committed suicide on 08.12.2015, in connection with which, the respondent initially registered a case in Crime. No.951 of 2015 under Section 174 Cr.P.C. and during the course of investigation, the case was altered to under Sections 498(A) & 304(B) IPC. Now, it is the grievance of the petitioner that the accused had vacated the house and had gone away, in connection with which, the petitioner has given a https://hcservices.ecourts.gov.in/hcservices/

complaint dated 04.03.2016 to the respondent police which has been sent by post.

4. Under such circumstances, the petitioner is directed to go in person along with this order and give the same complaint to the second respondent-police, who shall enquire the same along with Crime. No.951 of 2016. In a case of this nature, no fresh FIR can be registered on the complaint dated 04.03.2016. That apart, a party has got a right to change the house after suicide had taken place in the house for so many reasons and that cannot be said to be an offence.
