ORDER

The petitioner has filed this petition seeking direction to the learned Special Court for Trial of cases under SC/ST (POA) Act cases, Namakkal District to consider the bail application filed by the Petitioner on her surrender in connection with Crime No.58 of 2026 on the file of the 2nd respondent police on the same day.

2. It is seen that initially there was some financial dealings between the petitioner and de facto complainant's husband for setting up a saloon and thereafter, for securing a job and later the petitioner refused to return the money to the de facto complainant. When the same was questioned by the de facto complainant, the petitioner attacked the de facto complainant and abused her in filthy language by using her caste name.

3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for R1 and R2.

4. In view of the above factual position, there shall be a direction to the learned Special Court for Trial of cases under SC/ST (POA) Act cases,

Namakkal District, to consider the petitioner's bail application, preferably on the same day of her surrender, in connection with Crime No.58 of 2026 on the file of the second respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (POA) Act, 1989. The petitioner shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of receipt of a copy of this order.
