This application has been filed to set aside the order of the learned Master dated 25.04.2023 in T.O.S. No.96 of 2013.

2. The applicant is the plaintiff. The learned Master has passed an order on 25.04.2023 to reject the plaint by observing that the plaintiff has not paid the Court fee within the time granted by the Court.

3. The learned counsel for the applicant submitted that the plaintiff is a senior citizen and he is aged more than 80 years; as there was some difficulty in getting touch with the plaintiff, Court fee cannot be paid within the stipulated time. He further submitted that the additional Court fee will be paid if short time is given.

4. The learned counsel for the respondent has got no serious objection in allowing this application.

5. Considering the representation made by the learned counsel for the

applicant, this application is allowed and the applicant is directed to pay the Court fee on or before 19.06.2023.

6. The matter is ordered to be listed on 20.06.2023 for compliance. 14.06.2023 bkn
