PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the respondents to register the complaint dated 31.05.2021 in CSR.No.80 of 2021 on the file of the second respondent.

ORDER

This petition has been filed to direct the respondents to register the complaint dated 31.05.2021 in CSR.No.80 of 2021 on the file of the second respondent.

2. The petitioner lodged a complaint on 31.05.2021, for which, CSR.No.80 of 2021 was assigned and thereafter, no action taken. Hence, he filed the above petition.

3. The contention of the petitioner is that on 31.05.2021, the petitioner after getting permission from the Officials was making arrangements for laying pipeline to take water. The said pipe was damaged near Ellapalayam Mariamman Temple. When the petitioner questioned the same, the Villagers therein who damaged the pipe attempted to assault him. Hence, he lodged a complaint, but no action taken.

The learned Government Advocate (Crl.Side) submitted that while the enquiry on the petitioner's complaint is pending, the petitioner's father was attacked by one Devarajan, Boopathy and Magesh for some dispute and a case in Crime No.117 of 2021 came to be registered for the offence under Sections 294(b) and 323 of IPC which is an offshoot case. The grievance in the petitioner's complaint dated 31.05.2021 seems to be the main reason for the said occurrence dated 27.07.2021. Hence, during the investigation of Crime No.117 of 2021, the petitioner's complaint dated 31.05.2021 would be enquired and investigated.

5. Recording the same, this Criminal Original Petition is closed.
