This Application has been filed by the defendants in the suit seeking to receive additional documents.
2.The documents as stated in the annexure to the judges summons, include the orders passed by the Hon'ble Supreme Court and a report of a former Judge of this Court and also a valuation report. 3.The learned counsel for the respondents/plaintiffs raised an objection stating that these documents are not at all relevant to the issues which are now adjudicated by this Court. But relevancy is an aspect which should be argued and even before the witness, necessary questions can be put as to how these documents are actually relevant and the witness could be asked to speak about its relevancy. 4.Therefore, I would permit the documents to be produced as evidence but of course subject to admissibility and proof. Issue of relevancy can be analyzed at the time of arguments.
