Order This Civil Revision Petition is filed by the petitioners seeking a direction to expedite the trail in a OP No.49/2026 pending before the file of the Family Court, Tiruvannamalai.
2. The learned counsel for the petitioners submitted that the marriage between the petitioners was solemnized on 30.1.2020 and they have been living separately since 2022. after more than four years of separation, they jointly filed a petition for mutual consent divorce under section 13B of the Hindu Marriage Act before the Family court, Tiruvannamalai. Though the petitioners are mutually agreed to dissolve the marriage, and despite the long period of separation, the Family Court adjourned the matter of 7.9.2026 without considering the petitioner request for waiver of the cooling off period. Such adjournment causes undue delay and hardship, especially when no useful purpose would be served by insisting on the waiting period.
3. Considering the prolonged pendency of the petition and facts and circumstances of the case, this Court is inclined to grant the relief sought for. Accordingly, (i)the learned Judge, Family Court, Tiruvannamalai is directed to dispose of the original petition in OP No.49/2026,
in accordance with law, within a period of three (3) months from the date of receipt of a copy of this order. (ii)The parties shall extend their full cooperation for early disposal and shall not seek unnecessary adjournments.
4. With the above direction, this Civil Revision Petition is disposed of. No costs. Consequently the connected miscellaneous petition is closed. 30-04-2026 Index: Yes/No Speaking/Non-speaking order JRS To The Judge, Family Court, Tiruvannamalai.
