Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, to direct the first respondent to regularise the suspension period from 14.5.92 A.N. to 31.5.92 as duty period and to grant promotion as Inspector of Police with effect from 1984 for the purpose of monetary benefits and consequently to grant the pensionary benefits to the petitioner. ORDER

The petitioner-Mr.P.Manas, by filing O.A.No.6328 of 2002 before the Tamil Nadu Administrative Tribunal, sought for a direction to regularise the suspension period from 14.5.92 to 31.5.92 as duty period and to grant promotion as Inspector of Police with effect from 1984 for the purpose of monetary benefits with a consequential relief. Later on, the said original application came to be https://hcservices.ecourts.gov.in/hcservices/

transferred to this Court and renumbered as a writ petition.

2. When the matter was taken up, Mr.R.Govindasamy, learned Additional Government Pleader appearing for the respondents submitted that the prayer of the petitioner has become infructuous, in the light of G.O.(D) No.859, Home (Police-III) Department dated 6.9.2005, which shows that the request of the petitioner for promotion as Inspector of Police has been granted. A reading of the said Government Order further shows that he also retired from service on 31.5.92 and his pay was also regulated as per the proviso to ruling 17 under Fundamental Rule 27. A copy of the said order has also been served upon the learned counsel for the petitioner.

3. In view of the above, the writ petition is dismissed as infructuous. No costs.
