ORDER

This Criminal Original Petition has been filed by the petitioner seeking direction to the respondent to provide the petitioner with personal security on payment basis for a period of one year.

2. It is seen that on earlier occasions, the respondent had observed in his memorandum dated 13.05.2017 and 16.10.2017 that there was a threat to the petitioner from his business rivals. In the light of the above observations, the petitioner was extended protection with a gunman on payment basis for a limited period. The present petition is for a similar prayer seeking for extension of protection for his personal security.

3. The respondent has filed a status report on 12.12.2017 stating that there is no specific threat to the petitioner.

4. Adverting the said remark, the learned counsel for the petitioner submits that the Commissioner of Police on discrete enquiries, was of the view that the petitioner has been receiving multiple threat calls from unidentified persons, demanding ransom from the petitioner and hence has opined that https://hcservices.ecourts.gov.in/hcservices/

protection should be extended to him.

5. In the light of the above remarks made by the Commissioner of Police and in the light of the apprehension of the petitioner, it would be appropriate to direct the respondent to consider the petitioner's representation afresh.

6. Hence, whenever the petitioner apprehends that there is a threat to his life and liberty, it would be open to the petitioner to approach the respondent with a representation and on receipt of such a representation, the respondent shall endeavor to dispose of the same, preferably on the same day, in the light of the observations made in this order as well as the observations made in the respondent's memorandum dated 31.05.2017 and 16.10.2017.

7. With the above terms, the Criminal Original Petition stands ordered.
