O R D E R

This Writ Petition is filed to call for the records and quash the Award dated 28.07.2020 passed in I.D.No.125 of 2018 on the file of the Presiding Officer, III Additional Labour Court, Chennai - 600 010. 2.It is submitted by both the learned counsels that the matter has been settled between the parties and to that effect the memorandum of settlement under Section 2(P) read with Section 18(1) of the Industrial Disputes Act, 1947 and Rule 25(1) of the Tamil Nadu Industrial Disputes Rules, 1958 has been signed.

3.The terms of settlement are as follows:

TERMS OF THE SETTLEMENT a) M.Selvakumar hereby agrees that he has voluntarily resigned from the service of the Management on 05/07/2017. b) M.Selvakumar has agreed to receive monetary compensation of Rs.3,00,000/- from the Management of Micro 2/5

Labs Ltd., in full and final settlement of all his claims monetary or otherwise including reinstatement and terminal benefits and benefits arising out of the award passed in I.D.No.125 of 2018 dated 28/07/2020.

c) The Management of Micro Labs Ltd agrees to pay the sum of Rs.3,00,000/- (Rupees Three lakh Only) vide Demand Draft No 120792 dated 27/03/2024 drawn on Canara Bank, in full and final settlement of all the claims made by M.Selvakumar including terminal benefits and including the claim arising out of the Award passed in I.D.No.125 of 2018. d) Upon receipt of the aforementioned sum M.Selvakumar agrees to issue a receipt to the Management to the effect that he is receiving the sum of Rs.3,00,000/- in full and final settlement of all his claims including terminal benefits and including the claim made in I.D.No.125 of 2018. e) In view of the settlement M.Selvakumar agrees that he has no further claim against the Management of Micro Labs Ltd, monetary or otherwise including reinstatement/reemployment including the claims arising out of the Award passed in I.D.No.125 of 2018.

f) Both parties agree to file a copy of the settlement in W.P.No.14603 of 2020 and request the Hon'ble High Court to dispose of W.P.No.14603 of 2020 as settled out of Court. 4.In view of the fact that the parties have settled the matter the Writ Petition is disposed in terms of the above settlement. However, there shall be no order as to costs. Consequently, the connected miscellaneous petition stands closed.
