Respondents PRAYER:- Writ Petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the 1st respondent to consider the petitioner's representation dated 01.04.2019 rectification of wrong entries made in the revenue records in favour of the respondents 4 and 5 and issue patta in favour of the petitioner in respect of 0.68.5 hectares, comprised in Survey No.980 and 0.25.0 Hectares comprised in Survey No.981 of Bodichipalli Village, Dhenkanikkottai Taluk, Krishnagiri District within the time to be stipulated by this Court. ORDER
1. The writ petition has been filed in the nature of a mandamus, seeking consideration of a representation given by the petitioner herein on 01.04.2019 further seeking rectification of, according to him, wrong entries made in the revenue records and issue patta in favour of the petitioner with respect to 0.68.5 Hectares in S.No.980 and with respect to 0.25.0 Hectares in S.No.981 in Bodichipalli Village, Denkanikkottai Taluk,

Mr.K.M.D.Muhilan, learned Government Advocate appearing for respondents1 to 3 forwarded the order passed pursuant to the said representation and the Tahsildar, Denkanikottai, had stated that there have been objections received for transfer of patta in the name of the petitioner and therefore, had passed an order on 10.07.2019 in Na.Ka.No.1706/2019/P1 stating that the petitioner may be advised to approach the Civil Court.
3. In view of that fact, a direction in the nature of a mandamus cannot be issued and accordingly, the writ petition is dismissed. However, giving liberty to the writ petitioner to approach subject to procedure regarding institution of a suit, appropriate and competent Court of Civil Jurisdiction to remedy his grievances. No costs.
