Respondents Writ petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the 1st respondent to furnish copy of the enquiry report submitted by the 2nd respondent before the 1st respondent in proceedings No.Na.Ka.No.E2/5030/2016, dated 19.01.2017.

Mr.K.J.Sivakumar, learned Government Advocate takes notice for the respondents. By consent of the parties, the main writ petition itself is taken up for final disposal at the admission stage itself.

2. The petitioner seeks for a mandamus directing the first respondent to furnish copy of the enquiry report submitted by the second respondent dated 19.01.2017 in proceedings No.Na.Ka.No.E2/5030/2016.

3. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents.

It is seen that in an order passed by the first respondent dated 23.04.2017, in an appeal arising out of patta proceedings, the petitioner was called upon to approach the Civil Court and establish his right by filing appropriate civil suit. It is further seen that the first respondent, for arriving at such conclusion, has also referred a report of the second respondent dated 19.01.2017 in proceedings No. No.Na.Ka.No.E2/5030/2016. Now, the petitioner seeks a copy of the said report for him to proceed before the Civil Court.

5. Therefore, the present writ petition is filed seeking for a direction to the first respondent to furnish such copy of the said report filed. I think there will be no prejudice on the part of the respondent in furnishing such report to the petitioner, since the same was referred to in the order passed by the first respondent dated 23.04.2017. Accordingly, this writ petition is disposed of, with a direction to the respondents to furnish a copy of the said report to the petitioner, within a period of two weeks from the date of receipt of a copy of this order. No costs.
