ORDER

Petition seeking bail in respect of Crime No.1 of 2026 registered for the alleged offences punishable under Section 9(n) r/w 6 of the Protection of Child from Sexual Offences Act, 2012 and Section 66 E of Information Technology Act, 2000, is on board for consideration.

The case of the prosecution is that the accused, who is step father of the victim girl, inappropriately touched the victim girl while she was asleep and threatened her not to disclose the same to anyone. Later, in September 2023, when no one was at home, the accused forced the victim girl into the bedroom and had sexual intercourse with the victim girl and threatened her not to disclose the same to anyone. Hence the case. 3.

Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is in no way connected with the alleged offence. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. He also submitted that the petitioner is in incarceration from 06.01.2026. Hence, he prayed for grant of bail to the petitioner.

Learned Government Advocate (Criminal Side) appearing for the respondent police, while opposing for grant of bail to the petitioner, reiterated the prosecution case and submitted that the petitioner committed penetrative sexual assault on the victim girl, who is aged about sixteen years old. He further submitted that the charge sheet has been filed and the trial has commenced.

Heard both sides and perused the materials available on record. 6.

Considering the nature and gravity of the offence and the fact that the victim girl was aged about sixteen years at the time of occurrence and also the petitioner committed very serious and heinous offence against the victim girl, this Court is not inclined to grant bail to the petitioner. 7.
